Voter ID Law challenge - IMPORTANT NEWS

staff - Posted on 25 October 2006

I am told that U.S. District Judge Algernon Marbley will hear the motion for a temporary restraining (TRO) order against Secretary of State Blackwell tomorrow at 2:30 pm in the U.S. District Courthouse in Columbus and that it's open to the public. Here are the legal filings that are incredible to read.

Here are a few snippets to show just what a train wreck this provision in HB3 is going to be and how chaotic its implementation is.

IF you have any reports of the Voter ID law not being implemented properly while voting early please Email BSB and I can pass it along.

Russell - that argument from one of your screenshots about "current" and the lack of definition for it in HB3? That's precisely one of the arguments I made yesterday about why the language (not the idea - a separate issue entirely which I'm NOT going into here) in Issue 3 makes it unable to be implemented.

Drafting legislation is not for cowards. You want to stop our society from being so litigious? One way would be to only pass better written legislation that demonstrates thought and thoroughness.

Mon. night for Montgomery Co. the question about the utility bill was asked.

And that's fine.
Because even in a perfect world (which Ohio's elections system isn't), you will have a wide variance in quality of poll workers and poll-worker training as long as you have 88 boards making independent decisions about this. And if you give individual poll workers the option to decide how to enforce this, who do you think they would question more if there was a discrepancy: a well-dressed businessman or a shabby, harried woman with a couple of restless kids in tow? You really do need to have consistent, defined rules.
Let's work together to retire Ken Blackwell from politics
Some kind of checks and balances.
Hey, I'm thinking of heading to the hearing, but I saw somewhere else (OSU Law) that the notice for the hearing sets it for Judge Frost at 1:30, not Judge Marbley at 2:30. Do you have better information? See http://moritzlaw.osu.edu/electionlaw/litigation/documents/NEOCH%20order%20setting%20TRO%20hearing.pdf
Plain Dealer has it in paper today: Frost was randomly assigned to this more recent case. Marbly was handling a similar case filed earlier this year (August) so Frost gave this case to Marbly as well.
Thanks!
when you go vote...take a current gov't issued id (if you dont have one, you are too irresponsible to vote anyways), and some back up to prove residency, like a utility or phone bill (again if you can't remember to bring those or can't get one before election day you don't deserve to vote). STOP ALL THE COMPLAINING....no wonder normal people see democrats as whinning little babies. heck, im a democrat and i see most of them as little babies. sometime for fun while you are at a party function, look around the room and try to pick out more than 10 half-way normal people...good luck!

Are you telling me that a senior citizen who can no longer drive and hence doesn't have a state issued ID is irresponsible ? What if they live in assisted living and have no utility bills in their name either ? Are they still irresponsible ?

What of the people who have just moved to the state and do not yet have a Ohio drivers license or their first utility bills ?

what about non driving students who live in the Dorms ?

The lists of people who do not have the required types of ID because of their lifestyle or situation has nothing at all to do with responsibility. Only a fool or a GOP troll would even suggest such a thing.

a senior would have a gov't issued id..i said nothing about a driver's id.

if they are in assisted living, they will have some sort of bill that they pay to have that service provided.

if you are moving you should get that taken care of in the first month..you have to register 30 days prior to election anyway.

sorry, anyone who fails to do these things would be irresponsible.

many people in assited living have their bills paid for by their fucking families asshole.

And right now a judge just issued a TRO and suspended this voter suppression provision. So it's mute until next Wednesday.

there will be something that has their name on it saying they live there.

grow a brain before calling people names

I think you first used the "ass" term.

You might want to grow a brain and realize that you cant use any old piece of paper with your name on it. the law is specific. Maybe you should read it instead of trolling around here with your Ken Blackwell talking points.

Anyhow - calling the host of this blog names because you cant stand losing the debate gets you banned.

if you read your own blog you will see that i can't stand blackwell or most of the GOP.

Disagree all you like. A judge seems to agree with me on this issue. I figure a judge has better understandings of the law than you appear to have.

Clearly you are in favor of making it harder for people to vote. I am not.

Looking at your list on the other thread it is very clear that you are not a Democrat, but a troll. That's fine. You weren't banned for your opinions, just the name calling you institued. If yuo think you can remain civil I have no reason to ban you.

it is very clear we disagree on the level of personal responsibility people should have, but i will make a deal with you for both of us to remain civil.

i do request that you not call me a troll.

I'm a pollworker and I'm one of those who moved but did not change thier address on thier Drivers License (it is changed in the system, but not on the card). When I realized what way the wind was blowing, I went this summer to the BMV to get a new card and was told they no longer reissue cards for change of address.

I've been talking about that marry and change problem for several months now after a judicial candidate was kicked off because of a related name problem.
lets stop with the name calling. That goes nowhere. Both make valid points. I do see problems with the ID law. Russell correctly states the non-specific wording. And the problems that moving and marriage cause, etc. Jerk, if you see this, I will respond to your Senate question when I get home, as I'm at my night class right now and don't have the time.

I don't need one. I don't have a utility bill in my name. (All in my roommates) I have not missed any vote since I tturned 18. (A looooooooong time ago) The only way I can vote is absentee.
Crooked Stream I encourage you to assist the efforts of the plaintiffs in the Voter ID lawsuit by communicating with Mr. Green of OVEST at (614) 893-2575. OVESTDem
